Terms and Conditions
Introduction:
Compeer Pty Ltd A.C.N 667 090 360 (“Compeer”) operates the Compeer information technology platform (Platform) through compeer.com.au and its subdomains (Website). The Platform facilitates financial services, including loans to Borrowers and investment in loans by users of the Compeer Lending Platform or Compeer Lending Platform (Schemes), collectively termed as Compeer Services. The credit provider for loans to Borrowers is Compeer Pty Ltd as Authorised representive of Chuuse Pty Ltd A.C.N 002 170 541 A.C.L 423638
Agreement: Accessing or using the Website or Platform binds users to these Terms and Conditions. Any individual accessing the Website is referred to as “you.”
Investors and Borrowers: Investors and Borrowers agree to the respective terms governed by the Compeer Lending Platform Constitution and Loan Contracts, which prevail over these Terms and Conditions in case of inconsistencies.
Use of Website: Users agree not to engage in prohibited activities outlined in the Terms and Conditions, including unauthorized use of Automated Processes, interference with Platform operations, or unlawful content distribution.
Compeer Profiles: Users must provide accurate information during registration and may have only one Compeer Profile, unless expressly permitted otherwise.
Use of Platform by Investors: Investors must apply to join the Compeer Lending Platform, adhere to investment procedures, and are responsible for accurate investment information provided.
Use of Platform by Borrowers: Borrowers undergo credit underwriting processes before borrowing, agree to loan terms specified in Loan Contracts, and pay applicable fees outlined in Loan Contract Schedules.
Processing of Orders: Orders, once matched, cannot be altered. Users must promptly report errors in their profiles or orders. Compeer reserves the right to refuse or suspend Orders.
Repayment of Loans: Borrowers must adhere to repayment terms specified in Loan Contracts and notify Compeer of any anticipated repayment issues.
Investor Reinvestment Option: Investors may opt for automatic reinvestment of received payments, subject to specified parameters.
Compeer Services Use: Users needing assistance may contact Compeer. Compeer may monitor user activities and communications.
Acknowledgements and Representations: Users acknowledge their responsibilities, agree not to impersonate others, and provide accurate information.
Communications and Notices: Users must follow prescribed procedures for communication with Compeer.
Liability and Indemnity: Compeer limits liability, and users indemnify Compeer against losses arising from fraud or inaccurate information provided.
Intellectual Property: Users must obtain consent for use of Compeer’s intellectual property.
Assignment: Users may not assign these Terms and Conditions without Compeer’s consent.
Platform Access: Users agree to comply with additional terms governing Platform access.
Links to Third-Party Websites: Compeer is not responsible for Third-Party Websites linked on its platform.
Severability: Invalid provisions shall be modified to the fullest extent permitted by law, without affecting the remaining provisions’ validity.
Dispute Resolution: Users may file complaints with Compeer, and unresolved complaints may be referred to the Australian Financial Complaints Authority.
General: These Terms and Conditions are governed by New South Wales law, and any disputes are subject to New South Wales jurisdiction.
